Title IX Notice of Non-Discrimination and Policy Title IX of the Education Amendments Act of prohibits discrimination on the basis of sex in any education program or activity operated by a recipient that receives federal financial assistance. Sex Discrimination also covers sexual harassment and sexual assault. Department of Education, conduct on the basis of sex that is: 1.
Taken against a person in the United States; 2. For the purposes of this definition: Whether conduct is sufficiently severe, pervasive, or persistent is determined both from a subjective and objective perspective.
A hostile environment can be created by oral, written, graphic, or physical conduct. A determination of a hostile environment considers the totality of the circumstances and includes: 1 the degree of interference; 2 the type, frequency, and duration of the conduct; 3 the relationship between the Respondent and the Complainant; 4 the nature and severity of the conduct; 5 whether the conduct was directed at more than one person; 6 whether the conduct arose in the context of other discriminatory conduct; and 7 whether the conduct implicates concerns related to academic freedom or protected speech.
A single instance may be sufficient for a finding of a hostile environment if the conduct is serious enough to reasonably support such a finding, particularly if the conduct is physical. Sexual Assault: An offense classified as a forcible or nonforcible sex offense under the uniform crime reporting system of the Federal Bureau of Investigation FBI. This includes forcible rape and forcible fondling.
Dating Violence: Violence committed by a person 1 who is or has been in a social relationship of a romantic or intimate nature with the person subjected to such violence, and 2 where the existence of such a relationship shall be determined based on a consideration of the following factors: 1 the length of the relationship; 2 the type of relationship; and 3 the frequency of interaction between the persons involved in the relationship.
